Abhyudaya Lotus Gardens is a residential plotted development on Budigere Road about 5 kms off Old Madras Road/NH4, its about 3 kms further towards Budigere from Prestige Tranquility and about 1 km from Mandur village.

- The developer is a new entrant and does not have any projects that have been completed
- The approval of the layout is pending, the layout plan does indicate that HPA norms have been followed. Update: 15 Aug – Approval Letter from HPA received, however final notification pending
- Developer’s brochure always include a host of facilities, whereas a local area approved project has to provide the basic facilities to get the release order whether the entire list of facilities will be provided and by when is still an open question
- Budigere Road is underdeveloped and primarily an industrial stretch (first 3 kms from NH4)
- Rs. 1050/- per sft may be slightly at the higher end for a new developer
- Proposed 300 ft ITRR running right through the project, sound/noise pollution, even during the night (thanks to Chitra)

As of 30th July the layout is at an initial stage of formation, the 60 feet entrance road to the project is being readied. BMRDA / HPA approval is pending and as per the marketing team the approvals are expected by 2nd week of August.
With Budigere Road receiving a lot of focus after the launch of Prestige Tranquility this layout will also probably get attention of customers .

Do not book any plots from either abudhaya or marketting company north – south properties located near by Ashoka piller jayanagar. He has taken 1 to 4L from 250 people but till now only 10 people got plots and registered. Believe me I am not a marketting guy. I am one of the stape goat who has invetsed in lotus garden project through north – south properties. He is not giving either plots or our money back.
If you do not believe me then go ahead and invest.
We could not invest in other builders since we had hope on north – south properties. now property rate got increased and not able to invest money.
Even i have got a call from a Marketing person about Abhyudaya Residency Phase II. Its of 3.5 acres and DC Conversion (not BMRDA approved). Any idea on legality of this?
After 16 months search, finally booked a plot with Abyudaya developers Y’day. Hope everything goes fine.

I had seen a project just after Mallasandra village in 2011. The contact person was Kalpesh Solanki from hkddesigns. I came to know about this project through an advt in TOI. Kalpesh had sent me a ppt for this project. From the location, I strongly feel its the same project except that its now being marketed by Rhymer. At that time, they were taking an advance of Rs 1 or 2 lac (depending on site dimension) for booking/blocking and the rest after BMRDA approval which was expected in 6 months. The price was around Rs 700/- per sqft which I had found pretty reasonable even for 2011! Phase-I of the project was already sold out to Defense and HAL personnel. In Phase-II, they were selling sites to individuals. Some reasons due to which I could not go ahead at that time were:
1. They were providing very basic amenities. There was no underground cabling. The reason was that it would increase the price and most of the defense personnel would not be able to afford it.
2. It was some distance inside from the main road especially phase-II.
3. Although the interaction with the marketing person was fine (he did not give too many false hopes/assurances), I felt the area would take quite some time to be inhabitable.
4. I did not want to buy alone but in a group and so I had shown it to a couple of friends. But none of them were too enthusiastic mainly because of the location.

The info you have shared pretty much matches with my findings about this part of Whitefield. And thanks, I have the brochures for both the projects.

But I have actually been shown both the locations, by both parties separately, they are on either side of NH207 – as per what they pointed out – almost exactly opposite each other (uncanny, isn’t it?). The parties claimed they are not same.
The Kalpesh Solanki one is under zone related issues (BDA maintaining that it is Green zone), while Rhymer claims theirs is entirely Yellow zone. The first one seems to be on hold, and as for the 2nd one, when asked for legal verification documents, i was told “this pre launch we are not giving any legal verification. If you require legal verification you need to wait for 2 months by which time we will be ready with all the papers and book a unit at that time at the prevailing prices.”

Thank you for the additional info. What is the pre-launch price quoted by Rhymer and how much is the booking/blocking amount. Is there any legal assurance/document which states that the money would be refunded if they do not get BMRDA approval within a stipulated time-frame. What is your opinion about the area ? I feel it will take quite some time for the area to become residential and presently its mostly an investment option.
Is there any scope for rate reduction? Have they shared any legal documents? Is there a need to check with Hoskote Planning Authority?

I need some information and your thoughts on Abhyudaya’s new project Abhyudaya Residency.
There was a court case on the land but the builder says that they have the matter resolved and they have a “Schedule” for the case (I didnt get what that meant).
– Can you please provide some inputs on this?
– How we can verify that the case has been permanantly closed and there are no legal hassles with the property?
Also There will be no BMRDA approval. The builder has applied for DC conversion but not yet obtained it. Although he is telling that he will get the approval in 15 days.
– Can this be trusted?
– Is no BMRDA approval OK?
A third issue is that of future road-widening. There is a road perpendicular to the Cargo road going towards Yelahanka. This layout adjoins this road and is only 5 fts away from this road. In future if Government plans to expand the cargo road (which I heard is going to become 180 ft road) and this Yelahanka road, would the layout land be taken up even if the land gets DC approved?

To check if a court case is resolved you ask for the OS number of the case and get it verified through a lawyer. Just because one case is closed does not mean that there will be no future problems.. again best to get in touch with a lawyer with all the documents. DC Conversion is ok, but then I think its better to go for a BMRDA approval as it ensures that roads, parks and civic amenities are properly in place before such an approval is given. Never take decisions in haste.. just because a developer assures you of a good pre-launch price, 15 days can become 15 months too… If its a BMRDA/HPA approved then the road plans will already be integrated into the layout masterplan so nothing to worry…

Kindly note that the Abhyudaya Developers have taken disputed land for this property and their properties also are in legal disputes. Please read the Vijaya Karnataka paper of few days ago. There was a legal notice about their budigere property sale agreement survey number being in status quo in high court. Buyers beware and do your own legal diligence. Do not waste your hard earned money by investing in the properties of Abhyudaya Developers – you are doing so at your own risk. You will be unable to register the land in your name.
Would you be able to share the details of the case if available including case number and if possible kindly share the notice that came in Vijaya Karnataka.

I have enquired with the Abhudaya Developers and they are saying that the approval number has been arrived. They said that on 20th Jan 2012 they will get the release letters/docs for sure from HPA. I want to know if some one else have got some dates like this previously. Have any one visited HPA and enquired? Have any one get the papers checked leagely? I have been given a photocopy and the approval number is written on top of it with the date 31.10.2011.
Harha: Does this letter confirms or assures that the survy number mentioned are approved and will be released?
Should we trust this developer since he is a new comer? Developer asked to book the site in 2 days to freez the rate else it will be drastically increased once the release will happen. The sales guy always says its BMRDA approval but its actually the HPA approval.

5 months ago the marketing guy said “next week we’ll get approval and the prices will increase” and thats what they are saying even today. Looks like the processing is still going on. I would prefer to wait for the documents and get a legal clearance. Please check with HPA once to be on the safer side. Since its only sites, it should be ok to even if its a new developer, just need to make sure that the amenities that they promise dont remain only on paper.
The layout falls under Hoskote hence HPA is the approving authority. Thats not an issue.

Not received the approval letter yet! The ‘2-3 days’ now does not even seem to be ‘2-3’ months! They have been repeating the ‘2-3 days’ joke since June/July 2011 like a tape-recorder. You can check even now. Call the MD Nataraj 9886026377 to hear the joke from him.. anyday!

For getting BMRDA approval it may take more than 3 montths from now and we dont know when the sale deed betenn land owner and developer happens. The developer asking us to pay amount to go for agreement or take the membership back. We are thinking to take money back.

Hi Raju, the layouts approved are updated at http://www.hoskote-pa.in/lol.htm but this is often quite delayed. Why not visit the HPA office and check it out.
Please dont think for Abhyudaya Lotus garden they are froud, cheater , will take your money and never registerer your property. will not listen to you once they got some amount, keep delaying / dragging you till hell.

Yes..I visited the site and he took me through the village road, but after coming out he showed me the road he is laying from the main road. I am not sure how to locate the road in wikimapia. I might go again in the coming weekends. I will confirm the same

I am a victim of Aishwarya Grandhill project. I just wanna caution the innocent buyers to be aware of the following facts regarding this Grandhill project.
1)The entire property of this project around 42 acres is under civil litigation.
2)In the BMRDA plan, approval is only for 42 acres of land. But the developer has developed sites on an acreage of 60 acres, including 20 acres Gomal Land and this Gomal land covers the Hill itself on the project site. Buying or selling Gomal land is illegal and criminal. BMRDA gave only 60% release of the sites subject to conditions.
3)I came to know that all the Aishwarya Projects are litigation properties.
4)BBMP dumping yard cum waste treatment plant, which is adjacent to Grandhill property will be functional for the next 40 years. But the developer is fooling the customers, saying that Karnataka Government is in the process of moving this dumping yard to a different location.

It takes a lot of good character to do this and needs appreciation. India needs people like you. Unfortunately most of the people keep quiet and watch others fall into the same issue with ill intention of ‘I shoulndt be the only one suffering’ or hoping to share the grief or hoping to get more number strength to fight along with them. Yes.. the proposal is to widen Budigere road to 300 feet. To avoid Mandur village, the road will take a deviation at New Baldwin International School and then join back after the village. Hence you see in the layout plan two roads.

Check link BMRDA – STRR – ITRR. See page 81, 82, 83 (as printed on the scanned sheet, serial numbers 1 to 52), you can see the Village name as Mandur and the survey numbers notified for acquisition. Get the survey number from the builder and look it up in the table.

I have seen a property called Sree Narayana Mutt phase 2 also around that area. Around 5Km from grindwell norton.

Yes, the deviation is at Baldwins. While approaching Budigere the deviation is to the right and I believe you are referring to Shivagiri Township which is on the road to the left after Grindwell Norton, in that case the road marked in the layout plan is not the proposed 300 ft road.

Coming back to Abhyudayam location seems to be good for me, with 300ft road and all. Issue is that they are first timers and not sure of their reliability

Is Abhyudaya Lotus Garden a better investment than Aishwarya Grant Hills?
Both are in almost same price range and very near to each other.
Did you see the approach road of Aishwarya Grand Hill? It runs through a village and is narrow. Also right below the hill is the BBMP garbage dumpyard and processing unit.. couple of points you may want to consider. On the other hand North South properties is a new developer and approvals are pending.
I went to both these layouts.
The road to Aishwarya (250metres) is an issue.
Now only I came to know about this BBMP garbage dumpyard.
Lotus garden is in a good location.
Even if IRR is not coming up also, the access from cargo road will be good.
But how to judge a new builder is an issue.
Pending approvals is not a big deal because we will be doing the registrations only after receiving the BMRDA approval.
Is BIAPPA approval needed for this plot?
BIAAPA approval is not required, the project should come under Hoskote Planning Authority (HPA).
