I got a mailer from a channel partner of Divyasree group which had details about an upcoming project in Whitefield area. I am not 100% clear on the location, but it is about 500 mtrs from the Whitefield police station, away from the Vydehi junction. This project is in pre-pr-launch phase, and the builder is quoting RS 4200 (all inclusive) at this stage.
The pre-launch will happen a couple of months down the line and the official launch will happen in the 3rd Quarter. The catch is however, the 5l :O comittment fee that they are demanding which is a bizzare amount. I am to buying apartments, and I was only looking at Tier A+ buiders, far far away from the city.
I wanted to know your opinion A) on the builder B) on paying such a high lock in amount. (Thanks a lot!) – Raama V.

In Stock Market, isn’t the price of a stock allowed to drop below the IPO listing price? Why can’t it be the same in Real Estate?
For investors, demand should dictate the prices. It’s a free market after all.
For builders, I agree, the equations are different. When you buy from builders, it’s a FLEECE market..!!!

A real estate broker told me that prices are not going to move in the next 2 quarters. He told me to take my time to decide on location, builder etc. Builders can hike price ONLY if there is DEMAND. If there is demand, then even if cement, iron price go Down, they will Hike the price. If there is NO Demand, even if raw material prices go Up, the apartment price can only come Down.
Rajeev, if you have conviction in your theory that prices are going to go up, you can wait another six months and then sell your apartment.
Does the salary increase rajeev for all the employees ? The average hike is just 8 -10 %.
This is to take care of inflation..there is no point in marketing for the builder..builders are already making cool 30 % profit..they just need to reduce the price..that is all.
Where are you getting this info like everything has gone up. But then why metal stocks are down for years now.If you do an XIRR calculation in excel, you will realize how difficult it is expect to even a 10% return on flats over 10 years esp if you put 80L-1 Cr as initial price.This includes everything.Reg,wood works ,decorations ,bribes etc.Yes, if interest rate falls by another 3% or more then equation may change.But not at 9-10%

Not finding buyers, builders will soon reduce the rates.
So, this reduction in flat prices and increase in freight cost will balance each other. Therefore, prices will remain stagnant for a long long time.
No hurry.
Builders will not reduce price, they will only come out with different schemes, which is one way to commit a person into buying. If things do not change, they will delay and later stop construction activities until they find the required cash flow which will also include builder employees being fired to reduce cost. They will again recruit once they see demand.

Good to see so many people are following real estate, it mean that either you are interested in buying or selling your house. For the sake of following you will not come to this place.
Inflation is going up and up since last many years and the real estate prices also. If some one says that builder is not able to sell or no buyer in the market, THINK then why the PRICES have the properties are GOING UP AND UP.
I have not come across good builder who in the past have reduced the prices, It can happen that number of sold unit may vary.
I am sure you all would have talked to the builder and checked the current price (which is higher than the price quoted last 5-6 months back).
If have not done, please do that.

@rajeev : prices for last 10-12 months have been stagnant at best. If you strictly go by the price list, yes the marked prices may have increased a bit but if you negotiate, the real price is same as it was a year back or so. Interestingly, the availability list is also more or less same. of course the builder doesnt share availability list publicly but i asked about the same few houses that i asked almost a year back and they were still available. what does all that tell you?
I don’t know how real estate prices could come down in the long run in a country like India where there is a scarcity of land when compared to population. Unless the country goes into war or recession or such extra ordinary situation prices can never go down. If it goes down without any such reason it would be temporary drop. To understand demand / supply you don’t need a doctorate in economics.
Go out people and buy some real property instead of trolling. I have seen marketing folks come down by 15 lakhs on 1cr property in like 5 mins of discussion. So don’t chase cat- A builders. They are tough to bargain. Instead go for Cat-B builders if location is good. I can bet you, u will get very good bargain if u talk with conviction. Take my words.. You will not be disappointed..
Btw, since I bought in Divyasree RoW, I would like to justify it is good property for the price they are quoting for location ( personal choice). Also bargain if u could get at good price with builder/ resale.
But pls stop giving false hopes to first time buyers to expect fall in price and wait for that.

Reason for delaying agreement signing is so that they can avoid paying penalty for late possession, since meter starts from date of signing the sale agreement.
G , delayed penalty is payable post crossing of date on which possession is committed after considering grace period of 6 months . It is not linked to date of signing of agreement . Ex- if x tower is committed delivery on June 16, penalty for delay starts post expiry of 6 months ie Jan 17. Date of signing and penalty have no connection.
Has anyone gotten the payment schedule through possession including the actual breakdown of %. I bought in phase 2 and ROW said the possession is not until June 2017 but the schedule they have shared goes only as far as June 2016 until the last floor slab is done and between June 2016 and June 2017 there is no mention of breakdown, to me it looks like they will force me to pay 90% by June 2016 and remaining 10% from June 2016 to June 2017, which if true is unacceptable…any experiences from folks from Phase 2 and have they received exact payment schedule from now till possession including % breakdown
I confirmed w/ ROW about payment schedule and it is confirmed that phase 2 is targeting for completion in June 2017 but 90% of the payment is due by June 2016, that means if you bought a flat for 60L, you pay 54L by June 2016 and remaining 6L distributed over last 12 months. That is nice way of making the money, this is very unusual compared to other builders. Happy to hear other people’s experience. Now I also understand why ROW is offering prices that are inclusive of everything vs. splitting it (such as BWSSB etc) so they can charge more money sooner.

Have you ever seen any other builder payment plan ? Most of the builder take 90% of money on slab completion. Remaining to be paid on possession. Time difference in possession and slab completion is always > 1 years.
Builder like Prestige have time bound plan, every 3 month you pay some amount irrespective of construction.
Request you to do your research before making comment. In case if you didn’t like payment plan, no-one stops you to cancel the booking.
If you are from the builder I understand your comment but don’t appreciate your attitude. I have bought with Salarpuria too and they are not cheating like ROW is. It took me 3 emails to get an answer on %, if ROW wants 90% at roof completion they should spell it out at the time of booking. Lack of transparency is what I am questioning. Yes, I will cancel and many others would too.
Gautam: Its construction linked if they construct 20 floors by june 2016 then yes they will ask for 90% of the money. Remaining 1 year is needed for electricity/water/tiles finishing.
But in general there will be a delay of 1-1.5 yrs so payment plan would be a bit relaxed.
For ex. Nov – Dec phase 1 2nd floor slab was planned but it is done only for 1-2 towers and other towers are still at basement.

Here is my opinion based on my very limited knowledge in this field:
Divyashree particularly ROW (their synonym Assetz Marq) both are pretend to be a Grade A builder. After seeing these many comment and they want to pay us 90% at once terrace floor slab is completed, clearly indicates they don’t have ethics and spoiling this industry.
These project are hyped by brokers and some online blogger and many of us are going ahead with it but then before you believe them I would suggest you to evaluate other established A grade builder and their payment plan, I am writing this after checking A grade builder payment plan and per it one need to pay 75% of base price (+ car par and ST and VAT) on terrace floor slab is completion. Remaing 25% are 5% each on 1. Completion of internal plastering 2. Completion of external plastering 3. Completion of paining 4. Completion of lift installation 5. Possession.
On the top of that BSWBB etc are around possession which again is roughly 10% of total flat cost.
So do better we do bit home work and then decide.

ROW is built on Mivan technology, so where would be plastering ?
One must note that RealEstate is still unregulated industry, so often (~99.99%) builder wins and consumer/we loose. It is hard fact.

Me too. ROW guys called me and tried to justify why they are ripping me off :-). The conversation was funny. I asked what is the current rate, they said same as before so I asked 0% appreciation since June 2014 when I booked then they said, no, on Oct. 1st they increased by Rs. 200 so I said 3% return in 6 months, which is less than what banks offer and why would someone buy, they it is what it is. I asked if I were a buyer you would quote a different price and then they said it depends by apt. etc. It is unfortunate Divyasree is cheating like this. Please stay away from these guys is my take away. I said you guys are ripping people off by not being transparent at the time of booking and they said I am ok to interpret it like that.

Now that’s the problem. We all tend to believe that RE investment is a one way game i.e Prices MUST always increase. This perception has to changes.
Understandably, Builders are caught on the wrong foot. Neither they can sell for cheaper (because of investor’s pressure) nor can they sell it at current high prices (no new takers). This deadlock is expected to continue for quite some time.
You computation of 3% returns in 6 months is not correct since you have NOT paid the full amount. Assuming you have paid only 33.33% of the amount, the Rs 200/- increase is on 1/3 of the total value and so your return is 9% in six months. Most investors in RE play the leverage game where the pay say 20% to 50% of the total amount but the appreciation is calculated on the whole amount. However, going ahead I dont think RE will witness such appreciation. Also, the builders are becoming more greedy where they try to get 80-90% of the amount in 1-2 years itself and then delay the project. I have seen Diyasree Elan on Sarjapura Road and it looks very cramped. Still, I am surprised that there are many buyers at exorbitant prices.
Even I am surprised that people are buying such cramped homes in Row with exorbitant prices.. The living/ dining/ bedrooms all r cramped pigeonholes in all the plans except the bigger 3 BHK. Also, the common area is so small and cramped here that u don’t get a feeling of living in a decent community also. I have never seen such small common area anywhere and living room the size of bedrooms and bedrooms still smaller….
I think I will buy there for temporary home as in case if it is late in the night till my work finishes, I can use them.for those days only… How can people buy and stay in such small dimension homes permanently.. I really don’t understand…

On what basis you mentioned that common area is small ? Compare to other A category builders Divyashree is giving much more common area.
2bhk size = 1047 sqft
Room size is 10 * 12 and 12 * 12
hall + dining = 224 sqft.
Checkout brigade cosmopolis: 1270
hall + dining = 216 sqft
one room is 11 * 12.5 , mbed= 12 * 15
only mbed room and kitchen are bigger but you pay for 1270 sqft

I don’t know about ROW but faced similar attitudes and more than 90% payment plan in Assetz Marq and very high outrageous penalty Charges on cancellation of apt (22 lakh rupees for 3 BHK….). If I cancel my apt, The builder doesn’t give me anything at all ….. Then why so high cancellation charges..????? these builders are ripping people off.
I had no intention of cancelling, but still in case of any undue financial emergency if I might, then this highly outrageous charges are unacceptable by me at least (I don’t know how other people are ready for this). So cancelled my booking there and bought in North Bangalore from a top CAT A builder in Sobha City.
All investors/homebuyers just don’t jump without all these hidden charges……else you will get into their trap and not only lose your hard earned monkey but also your night’s sleep. Be careful of Assetz or any other builders and check out the final prices without reg and these stupid hidden charges before taking decision. If u search u may get and may be with slight difference you can go for CAT A builders like Sobha, prestige, brigade, purva etc. and have peace of mind that ur hard money is invested with premium builders who have already established themselves with many years experience and lots and lots of premium projects. There are many projects of CAT A builders in North Bangalore like Sobha, purva, mantri, Karle, Brigade which seems to be good for investments since now North Bangalore is considered as the next Center of bangalore and the next Big Thing ….
North Bangalore is accessible to white field MG road, Indira nagar, and Bangalore International Airport. I am not saying this only because I have invested here, but I was also surprised to see the number of BIG BIG projects in Hennur and Thanisandra roads and seeing the great potential it has in the coming years. Already Manyata Tech Park and Kirloskar are there. Many are coming up like Karle. town centre, Bharatiya City and Govt has sanctioned two more tech parks in North. Aerospace tech park near BIAL…..etc. due to all this, the yelahanka which we all used to consider as outskirts of bangalore has become one of the happening places and prices have started to soar there…hence I am confident that Thanisandra and Hennur are the next Big upcoming areas in whole of bangalore… All the best in your hunt for your homes ..????????

Same with assetz Marq they r ripping people off by not being transparent while booking. Once you are in, they have trapped u with high cancellations and lock-in periods and all. Whatever they charge with their exorbitant prices (many times more than sobha, prestige, and all), but at least they should be transparent with their total costs and not hide and rip people..my 2 cents
I bought through indiahomes.com (as the real estate agent) and they are suppose to help me close the agreement w/ Divyasree and everytime I ask them what happened they tell me it will be done in a next few hours. Initially they were surprised that it wasn’t done when they are the ones responsible for getting it done.

I recently requested for them to send the Payment Schedule and as per that they would almost collect 90% of the money from me by sept 2015 itself where as the actual handover will only after Nov 2017. No builders does that and while booking they promised the other way.
@Gautam: Are these real estate agents any helpful? I found proptiger folks quoting higher pricing itself.. how much they normally charge or they get some commission from builder itself ?
ROW is my third property and first time I went through broker and got comfortable and did not do my due diligence with my lawyer and ended up in this bad situation. Lesson learnt don’t rely on brokers and have your lawyer deal with the builder directly, then the builders pay attention. My lawyer paid attention to every detail when I bought in salarpuria senorita and boy what a smooth sailing…Bangalore is on rampant growth so builders could care less who buys and who doesn’t at their terms but there is nothing that stops us from picking the right builder, we buyers have plenty of options too so why settle for ROW like builders looking to rip us off 🙁
This project has lot of amenities. Owners will have to close atleast 5-8 amenities to keep maintenance charge under 4 rs psft. if you try to maintain all amenities then maintenance will surely be 8 rs psft.
So this project is not for you. Its like buying Mercedes and looking for mileage.
The first question is – will they provide all the amenities which are not well documented in agreement ?
The second is they are asking to pay @of Mercedes BUT if they deliver Maruti like amenities then maintaining it would be a defiantly very expansive. If they do quality job these all can maintaines in less then 3 Rs per sqft.

Please avoid this project. Buyers who have given 5lacs as EOI money last year are still waiting for agreements. J block also has no approvals in place, yet the builders have taken booking amounts. The actual dimensions vary widely from one agreement to the next, the builder asking people to come to their site office to change it! How can they send out sale agreement document with such a serious error? Another thing to note, the project progress reports show considerable water logging in the basement parking area, all of the parking for this project is in the basement, how will the people manage? Most of the extra ameneties that were promised at booking are only on the fancy advertisements, promised on land which is to be BDA land. All this plus flyover on the property and a road for public use as bonus! Make sure to read agreement thoroughly well even though the builder asks to sign with booking amount. Bad project.
Hi G. How do you know there is considerable water logging? Where can one see the project report? We are planning on buying a 3 bhk in either towers K or L in phase 2 of the project.
Have a curious question, any expert advice will be useful. ROW has 1500 dwellings in 13.5 acres (350 in 11 acres in joy on the banks – same facility.. And 3500 in 100 acres in PLH slightly more facilities). Plus the location of ROW is in midst of offices..deserted during weekends et al..imagine someone visiting from long distance.. And during weekdays 20 to 30 minutes to travel 1 km. what is it I am missing.
PLH – 100 acre is full project, for apartments only approx 25 acres. undivided land share for apartments is very very low.

You reaching home everyday in 10-15 minutes or both you and visitor reaching your home everyday in 1+ hour 🙂
ask for copy of the sale agreement..all large township projects are going to take years to completed..sometime decades..so get the completion date of the project in writing and review the penalty clause. there are close to million homes not sold..so beware of your investment
if you are planning to live then check for any ready to move in apartment..that should be good enough

What ever 3 points you have asked, builder normally do not put them in the agreement. It will be only on brochures.

I have booked two flats in ROW and have paid the initial payments as well. Its been a month and a half and I am still waiting to get my signed agreement. The CRM team keeps giving me false promises. They even went to the extent of saying that it is signed and would be couriered to me. When I asked for courier details, there was no answer. They do not even respond despite regular follow ups. I am getting suspicious about the way these guys are doing business. Can anyone please advise on this. What is the reason that Divyasree is not giving me the signed contract?

Divyasree now changed the floor-to-floor height to 2780 mm (at the time of booking it was 2975mm). According to you, what would be the floor-to-floor and floor-to-ceil height that should be followed. Based on some article in The Hindu, the standard floor-to-floor height should be 2.9m. Could you please advice?

I remember the same story. I was told by marketing it would be near to 10 feet! but when we measured it in under construction flats it was only just above 9 feet!
Yesterday, I had to go to Tesco offfice (nearby ROW) from ITPL. Last 0.5 km took half an hour for me. A simple google maps history search would show full red color (non-moving traffic) from 5PM till 9PM (and in morning too).
Thats the reason why I removed ROW from our short list.

But I am bit unsure about what you mentioned about visiting the construction site to measure hight of ceiling . As far I know, DivyaSree 1is not allowing anybody to go to construction site. All that one can do is see construction from entrance platform.. Let me know how did you manage to do that. I am also keen to confirm what is claimed on height.
For the people who have office or business in Whitefield, they can not avoid the traffic in that area. No matter where you stay, you will have to come to your office on working day and pass through that traffic. to minimise the traffic time, only option is stay closer, at least you can walk for 500 meters if it doesn’t hurt your reputation or health. Other option is to change your office to other location 🙁 .. It’s a matter of personal choice and preference. If the persona doesn’t like the location itself (which should be first criteria of deciding along with budget), people should not waste their time and energy in looking at projects in such location and going into detail like floor height, ofcourse unless you are an real estate analyst.
I Agree that floor to floor height is very low for ROW, there is no doubt about it and it’s already in builder’s specification.

Hi Harsha, Looks like builder is not interested in committing on Occupancy Certificate (OC) on sale agreement as part of possession. Without OC i think it is very difficult to resale flat later after possession as banks need OC from prospective buyers of the flat to release loan amount. Do you think it is a red flag to stay invested in this project.? If yes, should we stay away from investing this project. Please provide your reply at the earliest.

You should approach collectively if you seriously want to get the clause included. If there is no violation from the sanctioned plan then getting an OC should not be a issue. Please check the sanctioned plan.

I had gone to ROW to check the final draft of agreement that i would be signing. I was surprised looking at below things
1. The final agreement was exactly same as draft agreement. No changes or critical amendments were made.
2. They have included the size of only “Additional” amenities which are tentative anyway. But they have not included the size of common amenities. When i asked about it, i was given a blunt NO. “We will not mention the size of common amenities” were her words.
3. Then i took 25-30 minutes to go through the sale agreement, i checked that the references in section 8.2, 15.2.1 to annexure-1 were wrong. They have added a new row in the annexure-1 but haven’t updated the agreement. So “holding charges” refer to “assessment charges”.
4. The only place in the agreement where they had mentioned “bay windows” was the floor plan in annexure-3. But to my surprise, they have taken off the only reference to bay windows in the final agreement, Upon asking, she mentioned it is part of the specifications. I checked the specifications and it was missing there also. Upon asking i was told “this is how it’ll be. We will not mention the bay windows. You sign if you want.”
5. Then i asked her to explain the “VAT and ST”. The formula she gave is
VAT = CA value * 70% * 14.5
ST = CA value * 40% * 12.36
I am not sure if this is how the ST and VAT are calculated. But when i asked if i’ll be provided with the tax statement from DS about the taxes paid by them to IT, she started beating around the bush about how this tax is not related to one unit but entire project. I thought it was complete BS anyway.
6. I asked about the changes (Khata A point specific) that were being discussed on sat and being agreed by DS, she told “DS agreed them verbally but will not commit on paper”
Then i told them “I am not signing the agreement with these many unknowns”. She sounded intimidating and said, “this is how the agreement would be and no changes would be made. Whether you sign now or 10 days later”. For me atleast #3, #4 and #5 were a must. She went on to suggest many workarounds like “pay now and sign later” etc etc. I was hell adamant on not signing and said it would take some more time for me to decide if i can sign with these many unknowns. Finally she agreed.
However i feel that at the end of the day,DS will have a say in most of the things. They will simply say “sign or exit”. At that point of time it would be a individuals decision to whether take the risk or exit. I was totally disappointed by the way thing went in there and was happy that i exited the room without signing, buying some more time. As per DS, close to 50 people have already signed the agreement. I also saw a couple of clients who simply walked in, signed the agreement and were out in no time. Strange!!

When I asked to cancel the booking then I was asked to pay the cancellation amount 30% and exist.
Got mail from crm@row stating that “Kindly note, since the payment is being made towards 2 beneficiary account the TDS is also payable twice.”
Just worried if this is going to create big hole in pocket which was not communicated earlier.
somehow worried by reading discussion on agreement clause and this double TDS..how many more surprises are still left..
Can someone share thoughts on double TDS. never expected unprofessional execution from DS, considering agreement and this TDS stuff.
I am not a buyer/seller in ROW. If my understanding of TDS is correct, it should not affect your final purchase price. for e.g., suppose your total sale consideration is 60 lacs, Then as a buyer, you need to deduct 1% TDS on this amount, deposit it with the government and provide the TDS certificate to the builder. So, you deduct 60K from 60 lacs and provide the TDS certificate to the builder and pay the remaining 59.4 lacs to the builder. Your effective cost still remains 60 lacs. The TDS has to be deducted from the agreed sale price and should not be paid as an extra amount.
The total amount of TDS to be deducted is 1% of total value of Apartment and remains the same even if it is bifurcated in 2 parts. For example if cost of apt is 60.0 Lacs, 1 % TDS will be 60,000/- and after deduction, you deposit 60,000/- to Income Tax and pay balance Rs. 59.40 Lacs to builder. That is how it works. From every installment 1% need to be deducted and deposited to Income Tax. In fact it will be on builders account. Nothing to worry on this part.
As a ca my understanding of TDS section is that as a buyer there is no additional outflow due to TDS. If the instalment amount payable to builder is 101, you pay the builder 100 and the government 1. In other words, if 5 lacs, then you pay builder 500,000/101*100. Trust this clarifies.
Unfortunately all builders make one sided agreement in their favor. Since the market is good they call the shots. We can only hope we can find another scapegoat when we sell in the market.

There is a potential risk of main amenities area being cut off from main building area due to proposed CDP road. I am not sure why they said CDP road is still “proposed” when agreements are signed and building construction reach 1st floor

The CDP Road is still proposed since the government has not decided whether or not it will be constructed, hence the term “proposed” will continue until such time as the government decides it is ready to go ahead.
Construction of our residential towers and agreement signings has nothing to do with whether the CDP Road comes in future or not.

If a road is proposed in the City Master Plan, how can you sign an agreement with prospective customers to sell the area off as part of the project?
If the govt does decide to build the proposed road at a later date, then what will be the recourse for the customers who would have already paid 100% pf the amount?

The proposed CDP Road reflects in our approved sanction plans from both BDA and BBMP. The CDP Road does not reflect or count towards the saleable area nor it is part of Undivided Share or UDS.

With the MRP based pricing and visible booking status project looks very fair and promising. Going through the draft Construction Agreement raises reasonable doubt about the initial promise. Approaching the builder to discuss and rectify them, the response creates more suspicion.
Main concerns:
1. Not enough specifics about construction material and fittings [e.g. make and quality]. Words like similar quality, high efficiency used insted.
2. There is a chain – Builder will hand over work to Contractor. Contractor will finish work and Builder will issue demand note. Once demand note is received Customer has to release fund. No clarity on responsibility of Builder over ensuring work completion by Contractor.
Generally in these cases Builder holds portion of funds of Contractor and releases after completion of maintenance period. No clarity over agreement between Builder and Constructor in Construction Agreement.

Divyasree has 2 great schemes for our existing owners.
1. You can upgrade from any 2BHK or 2A+1A to a 3PRE by only paying the difference in carpet area. Pay 10% of the difference on Agreement signing and the balance on possession, you even continue to pay based on your existing apartment payment schedule !
2. For all 3PRE owners a new scheme allows you to move to a higher floor at greatly reduced floor rise price. You pay nothing upfront as extra floor rise charge is spread across existing construction milestones.

This is the scheme for existing buyers (who booked at lesser prices) to upgrade making can be affordable for them to move up and also making a room for new buyers to book at lower floors which could benefit them @ cost .
fyi. we booked at sixth floor earlier and with the scheme moved to 16th floor with lesser price of 3.6 lakh extra.. the original extra price was 10 lakhs approx.

@ bhaskar – thats what I said if you ask a preimium price and on top of that 10L for higher floors as floor rise to buyers it will be very difficult to find a buyer so better sell higher floors reduction in price.
why would they populate this scheme on public forum when they can do it internally to their customers -;)
My question is.. As these apartments are high rise buildings, will the water actually come up all the time? Coz, I am from Hyderabad and in some buildings there, you need to get some help to get it your apartment. Hope you understand what I mean.
