all – i am owner of one of the apartment and there is no issue with the court case. I understand its not all completed but comparing with many other projects its on right track. Almost all apartments are now occupied and there is no issue with living in the complex. Normal issues like delay in OC, khata etc but i think thats very common in bangalore and with big builders like prestige/brigade etc also. If somebody has a doubt then they can get the papers verified with lawyers but shouldn’t be giving wrong info to prospective buyers
Yes, there is no legal issue, but the builder and land owner are unethical. They are still doing some constructions for their benefit on the common areas and the land owner has big gates from his house to the property. This is a real issue here as he interferes in all matters. the commercial space is illegally constrcuted
The project was built on family owned property distributed only among the brothers. However sisters were not given there due share…hence the cases were filed as listed below. As per law every member of the family would need to get equal share, Please refer to the links as shared by Jag..

Guys broker told owner’s not settlin tis matter he’s creatin hell lot of neucance din pay my brokers proper commission also. I heard his name chandroji rao n son jagdish rao, tey jus collectin buyers amount doin nothin n bulders job was to construct n its done. V shud co operate n look into matter seriously n take som serious necessary action against owner. Broker said he’s stayin jus adjacent to apartment as v enter main gate v could see his 3 floor house. Plz share if u got any imp info.
I know of some friends who had booked flats here who have decided to get out of this. Even I was looking into buying here……get out as fast as you can….

Note sure how did you get to know that in advance? If you have some source than please do let us know as it will help us.
Now there is one more post from you that another case is filed in Police station or in civil court. How come you are able to know about all this?
Now the current post says that some broker is saying something about owners and builders.

So Don please let us know if you have pruchased the property and if yes did you get your money back? If yes then how? And how did you get to know about the court case before it got published? If it is through some broker would you please let us know about the brokers name?

Well as Andrew rightly pointed out, even am not sure hows ‘don” getting all the information. either he knows someone who has filed a case or someone is taking the help of social media to prevent others from buying flats here.
I have bought a flat (land owners share) and prior to this, I had consulted 4 lawyers and nobody found any sort of discrepancy or issues. BBMP had given a clearance to start the construction based on which this was started way back in 2008 – 2009. this is entirely an inside family matter which BBMP or the Govt has nothing to do with. Since the property prices r booming up, their fmily members would have thought of coming up with a new case to extract some money which they weren’t eligible for before.. Since mine is a land owners flat, I don’t have anything to to with the builder. The land owner stays right next to Rajatha and out of 100% they have 24% of share including the commercial outlets…
I also some ridiculous comments marking policemen coming and shooing us away…give us a break,,this is not any fairyland..the BBMP occupancy certificate has got nothing to do with these rumous..they will proceed with their possession certificate once the clearance is received from STP, RWH, Lift, BESCOM and Fire
The land onwer is a mess here. the commercial space is illegal and they have made constructions on the common space on which they have no rights.

I have purchased a flat in Rajatha Greens from the builder’s share and started looking at legal options once I heard of this court dispute.
I have consulted a lawyer and he has a copy of the court document. He is of the opinion that the buyers should take action to protect their interests as well. As of now in this case, there is no one who is looking at our concerns.
If you are interested in joining us, please let us know.We could all meetup somewhere to discuss the further course of action.Please do bring your agreement copy of the apartment so we are all sure that only genuine buyers are involved.

for all the people in this forum who have bought the landowners share, would like to inform that the person has passed on all the details and there is no case in any of the police station…its the landowner who has filed a case against them as part of defamation suit…as GK pointed out, we can meet up in Rajatha and continue further discussions..again the matter of fact is builders apartments + land owners..i already have 3 folks in number who have purchased from land owner and the rest who are from builder, am not pretty sure on how to pull them in…

The fact is there is litigation and whoever can shed more light with more information shd be welcome for house investors … better to group togeather get a lawyer and then take it up.

don, I don’t think it is complete outsourced to builders just for construction. They also have 70% share and they do sell flats. I booked flats here,i’m shocked to know about the court order, but yet to get the other details & speak to the builders….

I also booked the flat and speak to the builder regarding this issue.He told me there is no issue.
So dont worried.
Consulted my advocate. As per him, a bank (atleast SBI) wont approve loan if there is a pending litigation.
Even though there is a WOW factor (probably) associated with this project, his impression was not to take risk considering no shortage of good residential projects.

court order affects wit all those who ve purchased. consult ur advocate o cal tat no given in news paper. untill court order comes position cant be taken.

Guys – Please beware of this property. there are lot of issues with this property. apart from legal, the quality of construction is bad, though they advertised as NCC, NCC had no role in the construction…they were only marketing……there is something fishy about this property
Guys tis property partition suit is pending in court. os8961/2010. Rajatha greens apartments is yet to get court order. see indian express, kannada prabha n sanjay vani news paper 2/9/2012. public notice information has been published. do not buy tis ltigated property.

Plz tel ur advocate to get copy OS 8961/2010 frm city civil court Banks also dono abt tis case. Builders n land owners never provided tis info to any 1 jus wan all flats to be sold witout knowledge to public court case.
u owe to the bank …pls read the home loan docs they clearly state the liability is yours and irrespective of the legal position of the propertry the “borrower” that is You is liable to pay for the asset.
in other words they have given you the money irrespective of the legal standing of the asset !!

Recently we came to know from corporation that the developers did not pay the BWSSB money that he collected (also mentioned in our sales deed, registration copies) for almost 20 flats. Hope u guys are aware that the first 2 floors are commercial ! that shd be a big dampner as u can imagine the chaos this unwanted shops at the grd floor will cause not to mention the parking and the security concerns ! i rem a building on old airport road where there is a bar / bakery / saloon and property dealer shops on the grd floor imagine the gentry ! Hope you guys have taken the decision keeping in mind these facts !

STP & RWH are couple of key norms which has to be in place to get the approval from BWSSB. Im sure STP is in progress. whereas, i persume RWH is also in place.My concerns is, bore water avlbility & corporation water connection. Even I am waiting for a reply from Don on one of the earlier posts and he is no where to be seen. The BBMP has provided the clearance after verifying the docs and I myself have taken the loan from SBI which has their own panel of advocates.
I also got the docs (family tree of landowner and encumberence details) from 3 lawyers who didn’t find any issue.
Not sure who this ‘Don” is in this mail forum.
Anybody in this forum/discussion-thread got their loan appln approved recently (after the article got published in newspaper)..??

The builder Visalakshi Housing projects is very slow in construction the project is not yet completely ready. The common areas are yet to be completed wherein he has pocketed the money for the amenities from the owners. The construction quality is very bad. Also, the land owner is a nuisance. He is creating a lot of disturbances and he treats the property of the apartment as his own still after the sale. There is some commercial space and a lessor should not go for this as there are issues between the land owner and the builder.
